申请绿卡，工卡和回美证

转换身份拿绿卡（AOS）
K1拿到certified marriage certificate之后，准备好以下文件就可以申请AOS了。一般来说，建议在94卡到期前递交申请，保持合法的居留身份。但如果由于某些原因，耽误了申请也不必过分慌张。
需要注意的是，如果94卡过期后180天才递交申请，就不要使用AP进出美国，法律规定逾期居留180天，将受到3年不得再进入美国的惩罚。
至于K3有两种情况：可以选择在在签证有效期内转换身份或回广州面谈取得移民签证。如果选择回广州，就要注意与签证中心联系。
申请最好用certified mail with return receipt寄出。

注意事项
o 在每份材料的右上角写上自己的名字和A号码，以防遗失。
o 把寄出的每份文件都做拷贝，自己留底，包括支票。
o 移民中心接受私人支票，Money Order或Cashier’s Check。抬头写US Department of Homeland Security。
o 每份费用一张支票，如485费用，指纹费，工卡费，AP费等。
o 同步申请的话，所有申请可以放在同一个信封。

注：最近05年9月发现部分用网上通过书的申请者被要求递交通知书原件，如果实在找不到（也没有复印件）的话，可以把网上通过书和书面遗失声明一起再交上去试试。

3. Sponsor’s Bank Statement 担保人的银行存款证明。
4. Sponsor's tax return and W2 for last 3 years 担保人最近三年的税单和W2。（注：移民局最新规定，只需1年税单和w2。）
5. Other financial evidences 其他相关的担保证明（如最近的工资单pay stub，房产地契等）。
6. 注意：如果美籍配偶无法达到经济担保的要求，例如没有缴税，无法提供税单，则需要写书名声明，解释没有缴税的原因，另外找合资格的美国公民或绿卡居民作为共同担保人。共同担保人所需材料与以上所列一致。原美籍配偶担保人的864及身份证明文件仍旧需要附上。
7. 如果外籍配偶已经在美超过6个月，那么外籍配偶的个人资产也可以通过864A包括在经济担保内。
o 疫苗报告。最近（05年5月）nbc似乎已出台新规定，要求申请时就递交疫苗报告，否则将要求补材料。指定体检医生在这里找：

*如在国内已经打过疫苗，取得黄皮书，一般也应该到指定医生那里取得签名，但也有部分移民官直接承认黄皮书。
*是否应该在国内打疫苗，如果在美国的保险包括疫苗费用或者有政府的免费疫苗计划，那么可以过来美国才打。
*疫苗价格各地不一样，从几十到300多刀都可能。
*移民法规定，要获得绿卡，必须在面谈之前获得完整的免疫注射记录以及体检报告。尽管有些移民官面谈时不一定会检查，但为了保险，建议不要怕花钱，不要怕麻烦，在面谈时应该做好所有法律要求的文件。
*此外，国内做的体检报告有效期是一年，如果你的面谈日期是一年之后，需要重新做体检。但移民官有权延长有效期。
*主要的三针就是MMR，TD和CHICKEN POX，需要由移民局指定体检医生决定。

*中国体检时的胸透片，如果一切正常，入境时候一般无需出示。持移民签证者入境以后就可以自己收藏当作纪念品。K签的，部分移民局指定医生会硬性要求做结核菌皮试PPD（一般应该不需要做），而且结果呈阳性反应的（由于大陆注射卡介苗，阳性反应属正常），可以告知医生小时曾注射卡介苗且出示此胸片证明身体健康。参考：如何判断阳性反应正常：

工作许可证I－765和出境请假证I－131
申请I－485时可同步申请工作许可证I－765和出境请假证I－131，或收到485收据后在网上申请（K3未与485同时或以后申请的工卡<类别A9>暂时无法网上申请）。
K3的与485同时申请的工卡c9需邮寄到处理485的移民办公室。a9工卡需邮寄至nbc处理，地址是：

K1持有者在94卡有效期90天内可合法工作，也有部分地区移民局会发90天有效的A6工卡（既有免费的，也有收费的）。但一般如果不着急的话，与485同步申请是比较方便的选择。

K1在等待转换身份期间要出境美国需要事先申请I－131获得advance parole。AP一般是1年多次出境有效。持有AP出境一般在有效期内没有时间限制，但需要注意两点：不能错过转换身份面谈；夫妻分居太久对证明婚姻真实性没有帮助。
而K3在签证的2年有效期内出境不需要申请此文件。参考：

AP随处理移民局的不同，从一式两份到一式四份不等。式样见下图：
网上申请

1。网上申请是马上可以拿到电子收据。
2。同时4－8周内nbc也会给您寄书面收据。
3。支持性文件，如果有同时申请485，而且nbc已经输入电脑，那么可能可以豁免重复邮寄（段璎培mm的经验）。但个人意见，根据移民局的指引，仍然应该邮寄，以免耽误申请的进度。
K2/4可以和K1/3同步或以后申请转换。
K4在申请I－485之前必须先申请I－130或抵美后与130同步申请。
K2/4的485申请要准备另外一份跟K1/3一摸一样的文件。不能省。
K1 转换身份填表指南

Address C/O 这里是让某人转交的意思，如果不用转交，可以空着。
Social Security # 如果还没有，填none。
A # (if any) 可以在你的包2，94表或护照上找到。以a开头的号码。如果都没有，填none。
I-94 # 入境时填的白卡的号码，在表格的正面上方可以找到。 那个大的号码，不是有上角的小数字。

亲自上当地移民局申请AP。
需要出示紧急情况的证据，如一封家书，说老人身体不好，或用一份EMAIL,自己翻译一下,交上去的，另写一份非常诚恳的STATEMENT LETTER，就是说为什么你要申请AP，这里的格式只是参考，自己的要写具体一些。
并把所有的申请文件，如护照,I-94,结婚证等都附上。
有些移民局对紧急AP的发放不太严格，对证据要求不严格。有些移民局则相反，如果不是真的人命关天的事，他们就不批准。
递交申请后
递交申请后，通常4－8周内会收到回执。如果是由NBC中心处理的，可以根据回执上的档案号码查询进度。如果不是NBC处理的，目前还不可以网上查询个案进度。查询个案进度的连接：

在NBC申请的案件，经过NBC的初步处理（包括指模，EAD，AP等）后，将转往地区办公室等候面谈。查询当地面谈排期的链接（看district office的时间表）：

同时回执也通知了需要等待Biometric（生理特征，包括相片，签名等）和打指印的通知。
获得打指引通知以后，在指定时间带上护照和收据以及电话获得的预约号码上门打指印。

电话是：1-800-375-5283。按次序选1－2－6－2－4－0， 可找到话务员。工作时间：周一至五，东部时间上午8点到下午6点。
临时工卡 Interim EAD
由于移民局审理进度拖延，从移民局收到指纹和全部要求资料开始算算起90天后如果还没有收到工卡，可以预约上门申请免费的临时工卡。预约链接：http://infopass.uscis.gov/
需要材料：收据，护照以及当初随765申请寄出的辅助文件。临时工卡有效期长短不等。一般是180－240天。
更新工卡 Renew EAD
工卡有效期一般1年。
工卡到期前6个月可以申请更新。考虑到有interim EAD，大概提前4－5个月申请也可以。
程序，申请材料以及费用跟首次申请EAD一样，但要附上485的收据复印件以及第一张工卡的复印件。
搬家改地址
在等待面谈过程中，如果搬家，需要及时通知移民局。分两步走。
第一步：下载AR-11表，寄到表上要求的地址：

第二步：通知处理AOS申请的移民局，如果档案还在NBC，可以直接写信或打1-800-375-5283更新地址。
如果是当地移民局，建议上网预约后，亲自上门改地址。
如果是搬到别的地区移民局管辖的地方，还需要确定他们有把档案转移到新的办公室。同时，在旧的地址，除了通知邮局转信之外，最好让新的住户帮忙留意信件，这样才能确保不错过移民局的通知。
延期面谈
强烈不建议延期面谈。如果不是人命关天的理由（例如生孩子等），大部分延期要求很可能会引起移民局的注意，从而对案件特殊关注，进行特殊处理，无形中也延长等候的时间。
如果事非得已，必须确定当地移民局确实收到延期申请，最好能上网预约后亲自上门申请，带上不能出席的证据。
如果只能信件通知，最好用certified mail with return receipt，保留申请证据。然后在可以上门时尽快上门确定是否获得延期。
延期后需要等待的时间由各地移民局决定，无法预计。
转换身份面试
面谈材料清单
当初申请485的所有辅助文件，如果已交原件，那么带上复印件，否则带上所有原件。864担保书有效期是一年，面谈时应携带有效的864及最近3年的税单和w2。
提供真实婚姻的证据，如：亲朋好友证词，子女证明，共同的报税证明，蜜月旅行，共有财产，存款账户，信誉卡收条，银行信件证明等财务证明，驾照，水电费交付单，有夫妻俩人姓名和共同住址的信件及帐单，家庭相册等。
例如：

注意事项
所有到移民局面谈的人都怀著忐忑不安的心情，什麼该说，什麼不该说，什麼该做，什麼不该做，都是我们所关心的事。至於移民官的个性以及当天心情的好坏，也是个问题。该如何準备面谈，就像準备大考一样，备极紧张。以下是我们提出的一些具体建议，希望对将去面谈的人有些用处。
1.把所有的文件、资料、移民表格完整的影印一套，以便随时提供移民官参考。
2.如果您是以「与美国公民结婚」来办绿卡，移民官将会问您一些私人的问题，您要能回答的出来。
3.遵照移民官的指示，如果移民官要单独面谈夫妻，也必须遵从。
4.仔细倾听移民官所提出的问题，而且只就问题来回答。
5.如果不会英文，一定要带一位翻译。
6.一定要衣著整齐，不可随便。
7.一定要保持镇定。如果听不懂移民官的问题，请他再重述一遍。如果不知如何回答问题，就老实承认。如果该问题是申请中的一部份，您却不知道答案，将会引起移民官的怀疑，所以面谈前应该多演练一下。
8.面谈一定要準时。如果有事不能去移民局面谈，再重约的时间可能会拖到很久之后。
9.不可跟移民官开玩笑，但保持轻鬆是需要的。
10.夫妻不可因意见不同而在移民官面前起争执。有些问题，最好事先取得共识。
11.不可跟移民官起争执。如果移民官挑剔文件不齐，把影印本给他就是了。
12.要很有耐心地回答移民官所提出的问题。即使移民官的问题已经超出其范围，仍要耐心回答。
13.绝对不可欺骗移民官而隐瞒事实。若被发现，将造成无法弥补的严重后果，针对自己无法判断的问题，最好在面谈前先咨询律师。
面谈常见问题
注意：如果担心英文不好，应该提前找到翻译，如果移民官严格的话，不会允许美籍配偶充当翻译的。
如无特殊情况，一般是夫妻一起面谈。常见问题包括：

22. If you did not have a reception, what did you do after the wedding ceremony?

24. Describe the place where you lived right after the marriage. Number of bedrooms and bathrooms; furnishings; color of walls, floor coverings, appliances, etc; type of air conditioning, heating, etc; # of telephones, televisions, etc. Do you have cable television?
25. Where did you get the furniture? Was it already there, did you buy it, was it a gift, or did it come from your, or your spouse’s, previous residence?

27. Describe your bedroom. Where do you keep your clothes? Where does your spouse keep his or her clothes? Where are the bathroom towels kept? Where do you keep the dirty clothes?

面谈后
面谈如果获得通过，移民官相信婚姻是真实的，而且背景调查，担保材料等也齐全，移民官将在护照上盖I－551章。功用与绿卡一样。其实绿卡的正式名字就叫I-551
注：目前也有部分移民局不会当场盖章而让申请者直接等待塑料绿卡。
拿到盖章或塑料绿卡后离境不超过1年，不需要申请REENTRY PEMMIT。1年以上2年以内必须申请RP。
先盖章是因为绿卡不是马上能制作出来，在制作期间，你完全可以凭有效的551章进出境。
真正的塑料绿卡和欢迎信将在1-6个月内（一般4－8周）寄到府上。
I－551章样板：
绿卡是塑料的，背后有磁条，跟驾照和ID卡或信用卡同一材料，但更为精美一些。塑料绿卡样板：

如结婚已满2年，有可能获得的是10年绿卡，如结婚仍不到2年，获得的是2年有效的条件绿卡。
由于移民法制定不够严谨，地区移民官在判断10年绿卡和条件绿卡时，既可以用申请之日为标准，也可以用批准之日为标准，因此结婚满2年也可能只获得条件绿卡。

在条件绿卡批准满二周年的前90天内，向USCIS地区服务中心申请I-751转为正式绿卡（稍后详述）。在持条件绿卡期间，享有10年绿卡的所有权益。
背景调查
由于移民局严格的背调规定，经常导致面谈通过了也无法当场获得盖章通过。
背调的时间表从几天到十几个月，很难预测。唯一能做的是多跟当地移民局及背调有关机构联系，尽力推动背调的进度。
转换身份进行的背调包括三部分：
FBI clearance from the fingerprints FBI的指纹调查，也就是常说的Name Check，有效期15个月。指纹调查的进度一般比较有效率。
"IBIS" （Interagency Border Inspection System） checks IBIS名字对照调查，有效期35天。此调查比较简单，也很快可以结束。
"IP" agency checks IP调查，亦即以前所称CIA调查，终身有效。这是最麻烦的一项，而且移民局也不再公开承认有这项调查。
